This Is An Agreement Between GB Hosts And All Customers.

Activities Subject to Immediate Suspension/Termination.

Any hosting account that is used for Illegal, Abusive or Unethical Activity may be immediately suspended/terminated by GB Hosts without warning to you. Any misuse or overuse of the server will result in immediate suspension/termination of an account. Illegal, Abusive or Unethical Activities include, but are not limited to inclusion of or linking to, pornography, mp3's, obscenity, nudity, violations of privacy, hacking, irc related scripts and programs, non approved server scripts, eggdrops, computer virus, gambling, or promotion of gambling, and any harassing or harmful materials or uses, as determined by GB Hosts. You agree to indemnify and hold GB Hosts harmless from any claim resulting from your publications or use of Illegal, Abusive or Unethical materials. Although we will make reasonable efforts to alert you to such activities and allow you an opportunity to cure them within a 12-hour period after discovery, we are not required to give notice before suspending/terminating your use of our services if, in our discretion, your use is or results in Illegal, Abusive or Unethical activities. If a hosting account is terminated/suspended, the regular monthly fees still apply. Each individual hosting account is allowed 1 main domain name with all additional parked domain names pointing to the main site of the main domain, unless otherwise specified, using addons, or parked domains. GB Hosts reserves the right to suspend/cancel/terminate any account at any time for any reason. There will be no tolerance of any abuse of any of our support methods, which will result in immediate suspension.

Public Nature Of The Internet

Please understand that all information submitted on the hosting account shall be considered publicly accessible.Important and private information should be protected/backed up by you.GB Hosts is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider that you may use.

Unsolicited Electronic Mail

You are expressly prohibited from sending unsolicited bulk mail messages ('junk mail' or 'spam'). This includes, but is not limited to, bulk-mailing of commercial advertising, information announcements, and political tracts. In accordance with the CAN-SPAM ACT of 2003 S. 877, such material may only be sent to those who have specifically requested it. Malicious or threatening email is also prohibited. GB Hosts reserves the right to immediately suspend or terminate your use of our service if we discover such activity. Further, you agree to indemnify and hold GB Hosts harmless from any claim resulting from your use or distribution of electronic mail services through the service provided through this Agreement. Anyone using GB Hosts services for spamming will be immediatly subject to a 500 GBP cleanup/network abuse fee.

Service Fees

All payments are due on time, without exception. Any failed charges on an invoice are subject to a 10 GBP service fee. Accounts with any past due invoices are at risk of suspension and late fees. Any account suspended for more than a 1 day period will be terminated, by GB Hosts, without backup.

• Third Party Script Assistance
  GB Hosts retains the right not to assist clients with third party applications. This includes any script uploaded by the client, installed using cPanel. Any assistance, support, or troubleshooting provided by GB Hosts for ANY third party script or application will be subject to a 15 GBP service fee.

Account Cancellation

In the event you cancel your service, you will be charged in full for the entire month in which you canceled your service. Account cancellations for accounts with a negative balance will be passed on to collections, and all services rendered to the party with the negative balance will be terminated, including, but not limited to, domain registrations. In the event you have elected to prepay, subsequent additional months, GB Hosts retains the right to charge you an administrative fee of no less than 17% and deduct the administrative fee from the subsequent, future months' Service Fees before refunding them to you. There is a 10 GBP administrative fee for any illegitimate chargebacks placed against GB Hosts. Any illegitimate chargebacks or threatened illegitimate chargebacks are grounds for immediate account cancellation, and the amount passed on to collections.

Competition

Please do note that we will not promote any website that competes against GB Hosts. We will terminate any account which contravenes this policy excluding our resellers and dedicated server customers..

If you are found to be a competitor to GB Hosts we will terminate your account access and any subdomains, addon domains and/or parked domains which are associated with your account with no refund being given.

Illegal Scripts

We will terminate any account which contravenes our policies to illegal scripts. If the script is license based and we find you to be running it on an account on any hosting plan we will terminate this account without refund.

Backups

GB Hosts hosting accounts include a nightly backup service, however these backups are for GB Hosts administrative purposes only, and are in NO WAY GUARANTEED! Customers are responsible for maintaining their own backups on their own personal computers. GB Hosts does not provide any sort of compensation for lost or incomplete data in the event that backups do not function properly (even if the malfunction was due to negligence on GB Hosts part). We will do our best to ensure complete and accurate backups, but assume no responsibility for this duty. Always back your site up to your personal computer! We make no guarantees about the availability of backups.

We do however have a backup system in place that if anytime the server crashes and information is lost we will restore the backup free of charge to the member. You must request this via support ticket.

If you need a backup restored when there was no fault of any GB Hosts Servers we will levy a charge of 10 GBP and charge this to your next invoice.

• Credits
  Refunds will not be issued on accounts where a credit/upgrade/downgrade has been issued, and accepted by you as a resolution.
• Domain Names
  Domains will not be refunded under any circumstances. One registered we are unable to delete it so you should be careful when registering a domain name.
• Suspended Accounts
  If you violate any of GB Hosts terms and conditions we will suspend your account until we can reach an amicable resolution to the dispute. If you have a late payment due we will not reactivate the account until payment has been recieved. If you choose to not pay and there is a couple of months worth of invoices we will pass all accounts onto collections.
